Cain Velasquez denied bail for 3rd time in attempted murder case

Cain Velasquez, the Lucha Libre AAA Worldwide wrestler and former two-time UFC Heavyweight Champion  has been denied bail for the third time in his ongoing attempted murder case against Harry Goularte, the man who molested a young relative of Velazquez.

Judge dismissed testimony status argument, denies Cain Velasquez bail once again

During a hearing this Monday at the Santa Clara County Hall of Justice in San Jose, Judge Shelyna Brown denied Velazquez motion for bail after another attempt from lead defense attorney Mark Geragos, which marks the third time the 39-year-old has been denied bail.

According to the court documents MMA Junkie obtained, Mark Geragos had the argument that Harry Goularte, Patricia Goularte and Paul Bender not intending to not testify in a civil lawsuit should be looked upon as a change of circumstance in the criminal case against Velasquez.

Geragos also added that his client, who is facing 20 years-to-life sentence in prison for attempted homicide, was ready to post a $1 million bond along with agreeing all court requirements so he can get back to his family.

Despite what Geragos argued, Judge Brown once again denied Velasquez bail, stating that the testimony status is irrelevant when compared to the threat she opines Velasquez is. “Both factually and legally, I think the court got it wrong,” Geragos spoke to MMA Junkie on Thursday.

Velasquez has remained in custody since February 28 after he chased down and opened fire on a vehicle that was occupied by Harry Goularte and his stepfather Paul Bender. Goularte, who lives at a home-daycare business in San Martin, was charged with “a lewd and lascivious act with a child under the age of 14″ just days before and the child was revealed to be a close relative of Velasquez.

The former UFC fighter had missed Goularte and the bullet hit Bender instead. Velasquez is now slapped with 10 charges of being attempted murder, shooting at an occupied motor vehicle or aircraft, three counts of assault with a firearm, three counts of assault with a deadly weapon, willfully discharging a firearm from a vehicle, and carrying a loaded firearm with intent to commit a felony.
